6. Are there waves of warnings?

No. As a rule there are individual cases to which our attention has been brought. If we are notified of an online sales portal, several trademark infringements could appear at once, which we would then pursue simultaneously. Other than monitoring new trademark applications and forgeries, there is no systematic search for trademark disputes.


7. Does JACK WOLFSKIN proceed against special target groups?

We always proceed against forgeries. There are otherwise no special target groups that we systematically investigate and proceed against.


8. It is claimed in some media that JACK WOLFSKIN also issues warnings against homemade textiles. Is that correct?

The subject of homemade paw-marked products initially arose as a result of criticism of how we dealt with the internet platform dawanda.de. According to our research, the ten warnings we issued there exclusively covered products which were manufactured by machine or industrially and which could not be considered homemade. All were sold in the marketplace. With the removal of these products from sale, we view these warnings as concluded.

In October 2009, prior to the warnings for offers on this internet platform, we approached the platform operator with a list of 46 products which at first sight indicated a danger of confusion. These products were removed from the platform by the operator. Unfortunately, we cannot rule out the possibility that homemade items were also included and that their potential for conflict with our trademark protection would have been revealed by a detailed investigation to be less grave in nature.

In order to avoid such conflicts in future, we have now given priority to a dialogue process with the manufacturer/supplier instead of taking steps against such small-scale product sales.
