General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter "GTC") apply to all your visits to the JACK WOLFSKIN Online Shop (hereinafter "Online Shop") as well as to the use of the Online Shop.

Please read these GTC carefully before entering our Online Shop and placing orders for our products. By using the website and placing orders, you agree to the application of these GTC in their entirety. You can print or download the GTC here. We recommend that you keep a copy of these GTC for future reference.

Responsible for this website and the Online Shop is JACK WOLFSKIN Retail GmbH, a limited liability company organized under German law and registered in the commercial register of the Wiesbaden Local Court under HRB 24710, with its registered office at Jack-Wolfskin-Kreisel 1, 65510 Idstein, Germany (hereinafter "we", "us" or "JACK WOLFSKIN").

2. Contracting Party

Responsible for this website and the Online Shop is JACK WOLFSKIN Retail GmbH, a limited liability company organized under German law and registered in the commercial register of the Wiesbaden Local Court under HRB 24710, with its registered office at Jack-Wolfskin-Kreisel 1, 65510 Idstein, Germany (hereinafter "we", "us" or "JACK WOLFSKIN").

3. Ordering Options and Requirements

You can place your orders in the Online Shop (hereinafter also "Website") via the internet or by telephone. Our customer service is available for questions by phone on business days (Monday to Saturday, excluding public holidays) between 8:00 a.m. and 8:00 p.m.

Please note that with every order you confirm that you are older than 18 and that all information and personal data you provide to us is complete and accurate in every respect.

4. Delivery Area and Shipping Conditions

Orders placed through the Online Shop are delivered throughout the European Union (EU) and the European Economic Area (EEA), provided that delivery to the respective country is technically and legally possible. Depending on your choice, we deliver either via DHL or UPS directly to the delivery address you specify, to a parcel locker, or to a parcel shop.

We always strive to meet the announced delivery times. Delivery times for available goods within Germany are generally 1–3 business days after confirmation of your order. Longer delivery times may apply for deliveries to other EU/EEA countries. These will be shown to you during the ordering process before you complete your order.

We will inform you of any possible delays immediately. To the extent permitted by law, we are not liable for damages, liabilities, costs, or other expenses arising from a delayed delivery.

5. Shipping Costs

Packaging and shipping costs vary depending on the country of delivery and will be shown to you before you complete your order. The amount of the shipping costs depends on the destination country and the weight of the shipment. No shipping costs may apply once a minimum order value has been reached.

In the case of partial deliveries, shipping costs are only charged for the first delivery; subsequent deliveries are free of shipping charges. As a general rule, we deliver in our standard packaging. Any form of special packaging may result in additional costs.

6. Passage of Risk and Default of Acceptance

We deliver the ordered products directly to the delivery address specified by you. The risk of loss, damage, or destruction of the products passes to you at the time of delivery. Should a delivery be delayed for reasons for which you are responsible (e.g. default of acceptance or refusal to accept), the risk passes to you at the point in time at which the delivery would have taken place had you not been in default of acceptance.

7. Conclusion of the Contract

The presentation of our products in the Online Shop merely constitutes an invitation to the visitor of the Online Shop to submit an offer to conclude a purchase contract for the products presented.

You can view our product range and select and collect items using the "Add to Cart" button. You can view your cart at any time by clicking the "View Cart" button and remove products from the cart.

Your order is completed by clicking the "Buy Now" button, which simultaneously constitutes an offer to conclude a purchase contract for the ordered products.

After you submit your order, you will receive an email from us confirming receipt of your order. This order confirmation does not yet constitute acceptance of your offer to conclude a purchase contract.

Such acceptance only occurs once you receive an email from us informing you that your order has been shipped. This shipping confirmation email simultaneously constitutes confirmation of the contract. The contract confirmation is limited to the products listed in the shipping confirmation email as being dispatched for delivery.

JACK WOLFSKIN reserves the right to withdraw from concluding a contract. Reasons for rejecting your purchase offers may include, for example, unavailability of products or lack of payment authorization.

8. Right of Withdrawal

In connection with your order in the Online Shop, you have a statutory right of withdrawal, from which deviations are only permitted in your favor.

We hereby inform you as follows:

Withdrawal Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days from the day on which you or a third party named by you, other than the carrier, took possession of the products.

To exercise your right of withdrawal, you must inform us (JACK WOLFSKIN Retail GmbH, Jack Wolfskin Kreisel 1, 65510 Idstein, Germany, email address: eshop@jack-wolfskin.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).

You may use the attached model withdrawal form, but this is not mandatory. You can download the model withdrawal form here.

You may also exercise your right of withdrawal by simply returning the products to us within the withdrawal period. In this case, please always use the enclosed, pre-filled returns label.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

In addition, we provide an electronic withdrawal function ("withdrawal button") on our website. Using this button, you can declare your withdrawal from the contract simply and directly online.

Use of the withdrawal button is voluntary. You may also declare your withdrawal by any other means provided by law.

After submitting your withdrawal via the withdrawal button, you will immediately receive confirmation of receipt of your withdrawal on a durable medium (e.g. by email).

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the products back or until you have supplied evidence of having sent back the products, whichever is the earlier.

You shall send back the products or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract, to:

We will bear the cost of returning the products for you if you use the enclosed returns label.

You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.

9. Warranty Claims and Damages

We are committed to supplying you only with products of the highest quality. Should the products you receive nevertheless be defective or damaged, the statutory warranty rights apply to the goods we offer.

Information on the existence and scope of the statutory warranty rights is also provided by the warranty label mandated by the European Union, which is displayed on the respective product listing.

The statutory warranty periods apply to defects in the purchased goods. For consumers who have their habitual residence in another EU or EEA member state, the mandatory statutory provisions (in particular consumer protection periods) of that other state remain unaffected by the choice of German law.

Where an additional durability or manufacturer's warranty exists for individual products, this is indicated separately by the corresponding EU warranty label as well as in the relevant product description. The statutory warranty rights remain unaffected by this.

We will ask you to return the defective/damaged products to us for inspection and will repair, replace, or refund the purchase price.

In the following cases, a refund or replacement is excluded and we will return the product to you:

  • the product was not purchased in our Online Shop;
  • the defect was caused by failure to observe the care instructions;
  • the defect was caused by misuse or negligence;
  • the defect was caused by alterations to the product.

Please note that we reserve the right to reject claims for replacement, repair, or refund where the defect is attributable to normal wear and tear on products that have exceeded their usual service life.

Liability

JACK WOLFSKIN is liable without limitation for claims for damages or reimbursement of expenses, regardless of the legal basis, arising from intent and gross negligence, from injury to life, body, or health, and from breach of material contractual obligations. The claim for damages for breach of material contractual obligations is limited to the foreseeable damage typical for the type of contract, unless there is intent or gross negligence, or liability arises from injury to life, body, or health.

The above limitations of liability do not apply insofar as JACK WOLFSKIN has fraudulently concealed a defect or has assumed a guarantee for the quality of the products. The same applies to claims under the Product Liability Act.

10. Prices and Payment Terms

All prices include the applicable statutory value-added tax. We are not bound by incorrectly displayed prices. Where shipping costs apply, we will notify you of these directly before you place your order.

Payment Methods

We offer various secure payment methods, including credit cards (Visa, MasterCard, American Express, JCB, Diners, Discover), Apple Pay, Google Pay, PayPal, instant bank transfer, invoice, and gift cards. All payment methods offered are available to customers from EU/EEA member states under the same conditions.

We reserve the right, in individual cases, to exclude certain payment methods — in particular purchase on invoice — in order to safeguard against credit risk. However, such an exclusion may not be based on the customer's nationality, place of residence, or place of establishment.

To protect your personal data during online payments, we use tested encryption technologies (SSL). All personal data and data required for payment is transmitted in encrypted form.

Card

You can pay easily and securely with your card in the JACK WOLFSKIN Online Shop. We accept the common cards Visa, MasterCard, and American Express.

For card payments, we use the 3D Secure procedure to protect against misuse. Your payment is only authorized after you have authenticated yourself with a personal password with your card provider. During checkout, when paying by card we require your card number, the card issuer, the expiry date, and the card's security code.

Apple Pay

Owners of Apple devices can use Apple Pay to pay in the JACK WOLFSKIN Online Shop when using the Safari browser. This is available for use on iPhone, iPad, and Mac, with or without Touch ID.

Without creating an account in the shop, entering card details, or filling in tedious address fields, you can conveniently pay for the products you have selected.

Security — ensuring that only you can purchase goods — is provided by the required confirmation via Face ID, Touch ID, PIN code, or entry on your iPhone or Apple Watch (depending on the device used).

Google Pay

Google offers all holders of a Google account the option to store credit cards, debit cards, and electronic payment methods and use them for payment in the JACK WOLFSKIN Online Shop.

All that is required is logging in to your Google account — JACK WOLFSKIN does not receive any card data, only confirmation and the address data required to ship the goods as quickly as possible. This means you only need one login, skip entering an address by using the stored address, and remain secure, as you do not disclose any account data.

A payment method and billing/delivery address already stored in the Google account is not required. This can be set up during the payment process.

PayPal

For simple and fast payment, you can also pay by PayPal in the JACK WOLFSKIN Online Shop. When you select PayPal as the payment method at checkout, clicking "Continue" will automatically redirect you to your PayPal page. There you can pay conveniently using your email address and password. Your PayPal account will be charged directly with the corresponding purchase amount.

You do not need to be a registered PayPal customer to use this payment method. Simply log in to PayPal during the payment process. You can link your PayPal account to either your bank account or your card. Your payment details are then stored in your PayPal account and do not need to be re-entered for every online purchase.

Instant Bank Transfer (Sofortüberweisung)

When paying via Sofortüberweisung, you can make the payment conveniently during your order directly through your online banking account.

Via the secure payment form, which is not accessible to merchants, sofortueberweisung.de automatically initiates a transfer from your bank account in real time. The purchase amount is transferred directly to the bank account of JACK WOLFSKIN Retail GmbH.

To use sofortueberweisung.de, you only need:

  • a bank account enabled for online banking
  • your account number and bank sort code
  • the PIN (Personal Identification Number) and TAN (Transaction Number) of your online banking account
  • any further information required by your bank for online banking, if applicable

Klarna Pay Later

Select "Invoice" as the payment method at checkout. After your purchase, you will receive your payment information by email. You can pay this conveniently via the Klarna app or online. You can also temporarily pause a payment if you encounter an issue.

If you wish to return goods, you can simply register your return in the Klarna app to pause the invoice until the return has been processed. Klarna will update your invoice as soon as the goods have arrived at the returns center.

Please note that Klarna is an independent invoicing company. We have no influence if your payment via Klarna is declined. If you repeatedly experience difficulties with invoice purchase, please contact Klarna customer service directly.

Purchase on Invoice (for telephone and in-store orders only)

When purchasing on invoice, you simply transfer the amount due, after deduction of any returns, to our account. The invoice with details of the JACK WOLFSKIN bank account will be enclosed with your order. The invoice amount is due 14 days after receipt of the goods.

Default of Payment

If the payment service you have chosen (card provider, PayPal, or Sofortüberweisung) refuses to authorize the payment — for whatever reason — we will not accept your order. In such cases, you cannot assert any claims against us arising from the refused payment.

Invoicing

We reserve the right to issue our invoices exclusively in electronic form.

11. Data Protection

We take data protection very seriously and comply with the General Data Protection Regulation (GDPR) as well as the relevant national data protection laws. Our data protection information can be found here. We will also be happy to send this to you upon request.

12. Retention of Title

JACK WOLFSKIN remains the owner of the delivered products until the purchase price has been paid in full.

13. Copyright and Industrial Property Rights

Unless explicitly stated otherwise, we are the owner or licensee of all industrial property rights on this website. This website and all its contents are protected by national and international copyright laws. Use of this website does not grant you any rights whatsoever with respect to copyrights, design rights, or trademark rights.

You may print or download content from this website exclusively for your personal, informational, non-commercial use. You may not modify, copy, distribute, publish, transmit, or sell the printouts or copies in any way. In particular, you may not use parts of this website for commercial or business purposes without first having obtained an appropriate license from us or the licensor.

14. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Liability in the Event of Force Majeure

JACK WOLFSKIN is not liable for the non-performance or delay of services to the extent that these are due to events of force majeure that are beyond JACK WOLFSKIN's control and were not foreseeable at the time the contract was concluded.

Events of force majeure include, in particular but not exclusively, strikes, lawful lockouts, war, acts of terrorism, natural disasters (e.g. fire, floods, earthquakes), pandemics, and official orders.

The statutory rights of consumers, in particular in the event of defects, remain unaffected.

16. Governing Law and Jurisdiction

All contracts between you and JACK WOLFSKIN, as well as these GTC, are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers: If, at the time the contract is concluded, you have your residence or habitual abode in another EU or EEA state, the application of mandatory statutory provisions (in particular consumer protection periods) of that other state remains unaffected by the above choice of law. This applies in particular to the provisions of Regulation (EU) 2019/771 on the conformity of goods.

Place of jurisdiction: For claims against consumers, the place of jurisdiction is the consumer's place of residence or habitual abode. For claims against businesses, our registered office in Idstein, Germany, is the place of jurisdiction. For claims against us, our registered office applies as the place of jurisdiction, to the extent permitted by law.

18. Severability Clause

Should any of the foregoing provisions of these GTC be found invalid or incomplete by a court, the remaining provisions shall remain unaffected. The invalid or incomplete provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid or incomplete provision.
