1. Competition

These terms and conditions for participation (hereinafter “Terms”) apply to the JACK WOLFSKIN “Ticket Giveaway Raffle (hereinafter “Raffle”). The Raffle is in no way sponsored, endorsed or administered by META. Contact person and person responsible is only JACK WOLFSKIN Ausrüstung für Draussen GmbH & Co. KGaA, Jack Wolfskin Kreisel 1, 65510 Idstein, Germany, e-mail info@jack-wolfskin.com (hereinafter “JACK WOLFSKIN”).

2. Eligibility

The Raffle is open to all Instagram Users with a valid Instagram account, regardless of their place of residence. Participants must be 18 years of age or older. If a participant is restricted in his legal capacity, the consent of his legal representative is required. Persons involved in the conception and realization of the raffle, employees and vicarious agents of of JACK WOLFSKIN, and JACK WOLFSKIN STORES are are excluded from participation. Participants can only take part in their own name/ Profile name and own Instagram account. Only one entry to the Raffle on the official Instagram account of JACK WOLFSKIN per person is allowed. However, entries on Instagram and Facebook will be handled differently as different channels were used. Any entries made using an automated service (Raffle entry services) will be automatically excluded from the Raffle. If the conditions for exclusion are met, prizes may be subsequently withdrawn, or prizes already paid out or delivered may be reclaimed. By participating, the participants agree that their names may be published on the JACK WOLFSKIN Instagram channel. It is expressly not necessary to purchase goods from Jack Wolfskin to participate or increase the chance of winning.

3. The Raffle process

The entire Raffle begins on April 19, 2024 at 0:00 (CET) and closes on April 22, 2024 at 23:59pm (CET) (hereinafter “Raffle Period”). Entries received after this deadline will not be eligible. The Raffle takes place on the official Instagram and Facebook account of JACK WOLFSKIN (@jackwolfskin). To take part in the Raffle, the participant must follow JACK WOLFSKIN on Instagram and then comment on the post posted on @jackwolfskin that explicitly refers to the Raffle (hereinafter ,,Raffle post’’). JACK WOLFSKIN will publish the Raffle post during the Raffle period. This post can be commented accordingly by the participants. By commenting on the Raffle post, the respective Instagram account automatically takes part in the Raffle. Only one initial comment per person is allowed. This does not include responses to previous comments. However, both Channels Instagram may be used.

The Raffle entry does not require the purchase of any JACK WOLFSKIN products, nor does this increase the chances of winning the Raffle.

4. Prize

Among all eligible participants two main prizes, each consisting of 4x Family passes to the Bear Grylls “Never Give Up! Live Tour” on April 28th in OVO Arena Wembley will be raffled off. Total amount of the price is 99 GBP. Event Details: 28th of April 2024 at OVO Arena Wembly in London. Doors open at 18:30. Age Restiriction is 14+; 14-15s must be accompanied by an adult over 16) Seated: Under 14s must be accompanied by an adult.

The tour is about: Thrilling tales of survival & human endurance, previously unseen images & behind the scenes footage, making it an unforgettable experience for the whole family. No rights other than those specified in these conditions of participation can be derived from the raffle. Any additional costs associated with claiming the prize shall be borne by the winner. Travel to and from Wembley and accommodation costs are not included in the prize. For clarification, only the tickets are part of the price.

The winner is responsible for any taxation of the prize.

Jack Wolfskin is entitled to replace the prize with one of the same value and for a similar purpose if, contrary to expectations, the prize is not available. Entitlement to the prize may not be transferred or assigned to others. Switching to a cash replacement instead of the respective price is not possible.

5. Raffle procedure

From all valid entries, two winners will be raffled by lot by employees of JACK WOLFSKIN Ausrüstung für Draußen GmbH & Co. KGaA. Legal recourse to select the winner is excluded. JACK WOLFSKIN will announce the winner via the comments under the Raffle post on the JACK WOLFSKIN Instagram account on April 23, 2024. The tagged winners then have to contact JACK WOLFSKIN via Direct Message (DM). If the winner fails to contact JACK WOLFSKIN within three days, the claim to the prize will lapse without compensation. JACK WOLFSKIN will then determine, by lot, a new winner. The Winners have to provide JACK WOLFSKIN all necessary data to submit the prize, in particular: Name and Email Address. Final information about the prizes (participation vouchers) will be sent out via E-Mail to the winners within seven (7) working days after contacting JACK WOLFSKIN.

By participating in the Raffle, the participants agree that, in the event of a win, their Instagram account names will be published on the JACK WOLFSKIN Instagram account.

6. Liability

JACK WOLFSKIN shall only be liable – irrespectively of the legal grounds – if JACK WOLFSKIN is responsible for a breach of duty, the fulfilment of which is a prerequisite for the proper implementation of this Raffle, the breach of which endangered the achievement of the purpose of the Raffle or the observance of which the participant/winner can regularly rely on (cardinal obligation). In this case, JACK WOLFSKIN’s liability is limited to foreseeable damage typical of the contract. Jack Wolfskin is not liable for technical faults or other problems arising in connection with the Organization and running of this competition.

With the exception of liability for intent and gross negligence, Jack Wolfskin’s liability is limited to a maximum amount of GBP 99,00.

With the exception of intent, gross negligence, injury to life, limb or health, liability for consequential damage and indirect damage is excluded. Liability is also excluded for damages that are not typical of the contract or unforeseeable in the case of material contractual obligations, or for non-material contractual obligations.

The content published by participants may not be illegal, i.e. in particular they must not contain any insults or false statements of fact, or infringe intellectual property rights; in this case, JACK WOLFSKIN is released from liability towards third parties.

7. Cancellation and changes to the Competition

JACK WOLFSKIN reserves the right to cancel, amend or postpone the Raffle at any time without giving prior notice if it turns out that the Raffle cannot be run in an orderly manner due to actual or legal reasons. In such an instance, JACK WOLFSKIN will not accept any liability or any requests for compensation. Especially in the following cases, JACK WOLFSKIN is entitled to cancel, amend, or postpone the Raffle:

I) Changing of the promotion guidelines by Instagram or Facebook, in a way that promotion cannot be realized under valid regulations; cancellation of the contest by Instagram for whatever reason.

II) Technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware software, or other mechanical equipment; the unavailability or inaccessibility of any transmissions, telephone, or Internet service.

8. Statute of limitations

Unless otherwise stipulated in these conditions of participation, all claims arising from the competition are subject to the regular limitation period of 3 years.

9. Rights of use

By participating in this Raffle, the participant agrees that, in the event of winning, text, sound, image and video material of/with the winner will be produced. In the event of winning, the participant transfers the following rights about the materials created in connection with the winning of the prize (text, sound, image and video material) to JACK WOLFSKIN a non-exclusive, temporally and locally unrestricted right of physical and non-physical use within the scope of the statutory protection period. JACK WOLFSKIN accepts the transfer of rights upon receipt of the material.

The granting of rights to use the materials includes the right of reproduction, the right of distribution and the right of exhibition (physical exploitation rights), the right of lecture, performance and presentation, the right of public access (in particular on the Internet), the broadcasting right, the right of reproduction on visual and audio carriers, and the right of reproduction of radio broadcasts and of public access (incorporeal exploitation rights), to the extent legally possible. In particular, JACK WOLFSKIN shall have the right to exploit the rights granted against payment or free of charge. JACK WOLFSKIN shall be granted the right to edit the contributions and to adapt them to the intended purpose of use (such as retouching, color and resolution adjustments, textual changes, textual abridgements). JACK WOLFSKIN also receives the right to digitally modify the contributions and to form cut-outs. In doing so, JACK WOLFSKIN respects the participant's moral rights in accordance with § 14 UrhG (German Copyright Act).

Published contributions may be freely used by JACK WOLFSKIN worldwide. JACK WOLFSKIN also holds the rights of use for future and repeated use of the contributions (no remuneration).

10. Other provisions

These Terms and the Raffle is governed by the laws of the Federal Republic of Germany. If the participant is domiciled or habitually resident in another state of the European Union or in Switzerland at the time of commenting on the post on the official Instagram account of Jack Wolfskin (@jackwolfskin), the application of mandatory statutory provisions (in particular consumer protection regulations) of this other state shall remain unaffected by the foregoing choice of law. Legal proceedings are excluded.

Should individual provisions of the conditions of participation be or become invalid in whole or in part, the validity of the remaining conditions of participation shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.

There will be a complete release from Instagram by each participant. This Raffle is not affiliated with Instagram and is in no way sponsored, endorsed or organized by Instagram. Neither Instagram or Facebook has nothing to do with this Raffle economically or legally. Instagram and Facebook are exempt from any responsibility, which means Instagram and Facebook do not cooperate with us and is not a co-organizer of the Raffle. The participant uses Instagram and Facebook for this Raffle at their own risk. All inquiries regarding the Raffle should be directed to us. The legal process is excluded.

Privacy policy

Jack Wolfskin Ausrüstung für Draussen GmbH & Co. KGaA, Jack Wolfskin Kreisel 1, 65510 Idstein, Germany; e-mail info@jack-wolfskin.com is responsible for data processing in connection with the competition. Participation and proper implementation of the competition require that personal data be processed.

First and last name and applicable Instagram/ Facebook profilename and E-mail address are collected and stored for the purposes of the raffle.

The legal basis for this processing of participants' personal data is Art. 6 para. 1 sentence 1 lit. b GDPR (implementation of pre-contractual measures and fulfilment of a contract).

Storage of the data:

After the end of the competition, the personal data processed as part of the competition will be deleted no later than three months after the end of the competition, unless the participant has effectively consented to further processing (e.g. with regard to sending the newsletter) and/or Jack Wolfskin has no legitimate interest in further storage.

Right to information in accordance with Art. 15 GDPR:

Data subjects have the right to request the erasure of their personal data if the requirements of Article 17 (1) GDPR are met. However, this right does not apply in particular if the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

Right to restriction of processing pursuant to Art. 18 GDPR:

Data subjects have the right to request the restriction of the processing of their personal data as long as the accuracy of their data, which they dispute, is being verified, if they refuse the deletion of their data due to unauthorised data processing and instead request the restriction of the processing of their data, if they change their data for the assertion, exercise or defence of legal claims, after Jack Wolfskin no longer needs this data after the purpose has been achieved or if the data subjects have lodged an objection for reasons of their particular situation, as long as it is not yet clear whether legitimate reasons prevail.

Right to information in accordance with Art. 19 GDPR:

If the participants have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.

Right to data portability pursuant to Art. 20 GDPR:

Participants have the right to receive the personal data they have provided to Jack Wolfskin in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller, where technically feasible.

Right to object pursuant to Art. 21 GDPR:

Participants have the right to object, on grounds relating to their particular situation, at any time to processing of personal data concerning them.

Right to withdraw consent granted pursuant to Art. 7 (3) GDPR:

Participants have the right to withdraw their consent to the processing of data at any time with effect for the future. In the event of revocation, the data concerned will be deleted immediately, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

The above rights can be asserted by any means of communication specified by Jack Wolfskin.

Right to lodge a complaint pursuant to Art. 77 GDPR:

Without prejudice to any other administrative or judicial remedy, participants have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement if they consider that there has been an infringement of the GDPR.

If the participant is of the opinion that your personal data is being processed unlawfully, they can contact the data protection officer responsible for Jack Wolfskin at any time.
